Acceptable Use Policy

What you may and may not do with Caesar. Effective date: October 1, 2026

This Acceptable Use Policy ("AUP") is part of the Terms of Service between you and iSend LLC, doing business as Caesar ("Caesar", "we", "us"). It applies to everyone who uses Caesar under your account and to all content and Messages sent through the Services. Capitalized terms have the meanings given in the Terms. The Messaging Policy sets out the detailed rules for consent, opt-outs, timing and content, and it applies in addition to this AUP. Where carrier, Channel or Store Platform rules are stricter, the stricter rule applies.

1. Prohibited activities

You must not use Caesar, or permit anyone else to use it, to:

  1. Violate the law. Engage in any activity that violates the law or assists another person in violating it, including selling or promoting illegal goods or services.
  2. Contact people without consent. Send any Message without a consent that the law or the Messaging Policy requires, or after an opt-out.
  3. Send spam. Send unsolicited or bulk messages, or any message that violates anti-spam, telemarketing or carrier rules.
  4. Defraud or deceive. Carry out phishing, "smishing", "vishing", scams, fake offers, fake prizes, bait-and-switch pricing, fake reviews or testimonials, or false urgency, or collect money or data through deception.
  5. Impersonate. Pretend to be another person, business, brand or authority, misrepresent your identity or affiliation, or cause the Agent to claim to be human.
  6. Harass or harm. Send content that is harassing, threatening, hateful, discriminatory, defamatory, violent, obscene or sexually explicit, or that exploits or harms children.
  7. Invade privacy. Covertly track people, dox them, infer sensitive characteristics (such as health, sexual orientation, religion or immigration status), or use the Services to collect sensitive information (see Section 5.6 of the Messaging Policy).
  8. Infringe rights. Infringe intellectual property, privacy or publicity rights, or send content that you do not have the right to send.
  9. Spread malware. Distribute malware, ransomware, spyware or harmful code, or link to it.
  10. Use prohibited contact lists. Upload or message numbers that were purchased, rented, shared, scraped, harvested, randomly generated or obtained unlawfully.
  11. Evade controls. Rotate numbers, lines, brands or accounts to avoid blocks or limits ("snowshoeing"), conceal complaint or opt-out rates, or circumvent carrier, Channel or Caesar controls.
  12. Abuse the network. Generate artificial traffic or traffic pumping, message fake or test numbers at scale, or operate revenue-share schemes.
  13. Attack the Services. Probe, scan or test vulnerabilities without permission; overload, disrupt, scrape without authorization or reverse engineer the Services; or bypass authentication, rate limits or billing.
  14. Resell or share. Resell, sublicense or share the Services, or conduct messaging on behalf of other businesses, without our written agreement.
  15. Compete or extract. Use the Services, Output or our prompts and playbooks to build, train or benchmark a competing product, or attempt to extract our system instructions.
  16. Make high-stakes decisions. Use the Services to make, or support, decisions about a person's credit, employment, housing, insurance, education, healthcare or access to essential services.
  17. Rely on the Services for emergencies. Use the Services for emergency, life-safety or other critical communications.
  18. Violate sanctions. Use the Services in violation of US or other applicable sanctions or export controls, or for or on behalf of a sanctioned person or region (see Section 18 of the Terms).

2. Prohibited and restricted content and industries

Some content, products and industries may be prohibited or may require our prior written approval because of applicable law, carrier, Channel or other service-provider requirements.

You must not use Caesar to market or promote any product, service or activity that is illegal where offered or where the Recipient is located.

The following categories may be restricted or require our prior written approval:

  • adult or sexually explicit products, services or content;
  • alcohol, tobacco, nicotine and cannabis-related products;
  • firearms, weapons and explosives;
  • gambling, betting, lotteries, sweepstakes and contests;
  • pharmaceuticals, peptides, supplements, weight-loss products and other health-related products or claims;
  • financial services, lending, debt relief, cryptocurrency, forex and investment opportunities;
  • dating services;
  • other regulated or high-risk products, services or industries.

We may approve, restrict or prohibit any category, merchant, Campaign or use case based on applicable law, carrier or Channel requirements, age-verification requirements, compliance considerations or other risks associated with the Services.

Carrier, Channel and other service-provider rules also apply. Where those rules are stricter, the stricter rule controls. See our Messaging Policy for additional requirements.

3. Your account and your team

You are responsible for everyone who uses Caesar under your account, including employees, contractors and agencies. Anyone you permit to assist in operating your account must comply with this AUP, and you remain responsible for them.

4. Enforcement

4.1 Review. We may review accounts, Campaigns, Agent Settings, Messages and metadata to verify compliance, but we are not obligated to do so.

4.2 Immediate termination. We may suspend or terminate an account immediately, without prior notice, if we reasonably believe that:

  • you have materially or repeatedly violated this AUP, the Messaging Policy or another Policy you accepted when you opened or used your account;
  • you, your owners or your managers are committing crimes or working with criminal organizations;
  • you are using, or attempting to use, funds from criminal activity, or using the Services to launder money;
  • you, your owners or your managers are sanctioned persons, or your use would breach US sanctions administered by OFAC or other applicable sanctions or export controls.

4.3 Other actions. In other cases, we may, with or without notice:

  • warn you and request that you correct the issue;
  • throttle, pause or stop a Campaign, Channel, line or Message type;
  • remove, block or refuse to transmit content;
  • require additional verification, consent evidence or safeguards;
  • suspend or terminate your account;
  • refuse to provide the Services to you in the future.

4.4 Reporting. We may report suspected violations, and share relevant information about them, with any of the following:

  • carriers and The Campaign Registry;
  • Channel and line-infrastructure providers;
  • Apple;
  • your Store Platform;
  • payment providers;
  • law enforcement and other authorities.

4.5 No liability; fees. We are not liable for any action we take in good faith to enforce this AUP. You remain responsible for fees that accrued before a suspension or termination. You are also responsible for costs resulting from your violation, including carrier fines (Section 6.10 of the Terms).

4.6 Appeals. If you believe that we suspended or restricted your account in error, you may submit an appeal by email to [email protected] with "Appeal" in the subject line and any supporting information. We may review the appeal and may, in our discretion, restore, modify or maintain the restriction. Certain actions may not be appealable, including actions required by law, a carrier, Channel or other service provider.

5. Reporting abuse

If you believe that someone is using Caesar in violation of this AUP, or you received a message that you did not agree to receive, you may report it by email to [email protected] with "Abuse report" in the subject line, as described in Section 13 of the Messaging Policy. Security vulnerabilities should be reported to [email protected] with "Security" in the subject line.

6. Changes

We may update this AUP as described in Section 23 of the Terms. If this AUP conflicts with the Terms, the Terms control.
